Terms of Use

1. The service

Sifet is a web application that lets you organize your contacts into lists and send planned, automated email sequences through your own Resend account.

Sifet is offered free of charge until further notice: $0. No payment is ever collected by Sifet. Resend is an independent email provider whose sending plans and billing are entirely separate from Sifet.

2. Your account

• You provide accurate information when creating your account and keep your password confidential.
• You are responsible for all activity carried out under your account.
• You must be legally able to enter into these Terms on your own behalf or on behalf of the organisation you represent.

3. Your contacts and anti-spam compliance

You may only use Sifet with contacts you are legally permitted to email. When importing contacts and sending sequences, you confirm that:

• You have a valid legal basis (consent, legitimate interest or another lawful ground) to contact each person.
• You comply with the applicable laws of each recipient's country, including the EU General Data Protection Regulation (GDPR) and, where relevant, the US CAN-SPAM Act.
• You do not import purchased, rented or scraped lists whose recipients have not consented to receive emails from you.
• You honour unsubscribe requests promptly. Sifet provides an unsubscribe link and automatically stops sequences on replies, unsubscribes and bounces.

4. Acceptable use

When using Sifet, you agree not to:

• Send spam, phishing, misleading or unlawful content.
• Impersonate a person or organisation, or falsify sending identities.
• Attempt to circumvent sending limits, security measures or rate controls.
• Use Sifet in a way that damages the reputation or deliverability of other users.

5. Third-party services

Sifet relies on third-party services to operate: Resend for email sending and delivery events, and a cloud hosting provider for the database, authentication and application hosting.

These services are governed by their own terms and pricing. Sifet is not responsible for their availability, their billing or the decisions they take regarding your accounts with them.

6. Availability and changes to the service

Sifet is provided “as is” and “as available”, without any warranty of continuous or error-free availability. We may add, modify or discontinue features, and may suspend access in case of violation of these Terms.

7. Limitation of liability

To the maximum extent permitted by applicable law, KhoudAi shall not be liable for indirect or consequential damages, including loss of profits, data, clients or reputation.

Sifet's total liability for any claim is limited to the amounts you paid to Sifet during the twelve months preceding the claim — which, given that Sifet is free of charge, generally amounts to zero.

8. Termination

You may stop using Sifet and delete your account at any time. KhoudAi may suspend or terminate an account that violates these Terms. Upon termination, your data is handled as described in the Privacy Policy.

9. Intellectual property

The Sifet name, interface and software are the property of KhoudAi. Your contacts, sequences and email content remain yours; you grant KhoudAi only the limited licence needed to store and process them in order to run the service.

10. Changes to these Terms

We may update these Terms from time to time. The current version is always published on this page with its revision date. Continued use of Sifet after a change constitutes acceptance of the updated Terms.

11. Governing law and disputes

These Terms are governed by the general principles of law applicable at the operator's place of establishment, in a technology-neutral manner. For the processing of personal data, the GDPR applies where relevant.

Disputes are first addressed amicably by writing to info@khoudai.com. The courts of the operator's place of establishment have jurisdiction, without prejudice to the mandatory consumer protections of your country of residence.
